As with section 12 of the YOA, clause 32 of the bill provides that certain information must be formally conveyed to an accused young person at the time of his or her first appearance in court to answer to a criminal charge: the precise nature of the charge as set out in the information; the right of the young person to be represented by counsel; and, if applicable, the prospect and consequences of being dealt with as an adult if the young person is convicted (clause 32(1)).
À l’instar de l’article 12 de la LJC, l’article 32 du projet de loi dispose que certains renseignements doivent être transmis formellement à l’adolescent qui fait l’objet d’une dénonciation lorsqu’il comparaît devant le tribunal pour répondre à l’accusation criminelle portée contre lui, à savoir : la nature précise de l’accusation décrite dans la dénonciation, son droit d’avoir recours à un avocat et, le cas échéant, la perspective d’être assujetti à la peine applicable aux adultes s’il est déclaré coupable, et les conséquences qui découlent d’une telle accusation (paragraphe 32(1)).
