e time and place of attendance, signed by the person or one of the persons to take the examination, has been duly served on the witness within Canada, and the witness has been tendered the legal fees for attendance and travel, the refusal or neglect of the witness to attend for examination or to answer any proper question put on examination, or to produce any paper that the witness has been notified to produce, shall be

89 (1) Lorsque copie d’une ordonnance rendue en vue de l’interrogatoire d’un témoin et avis des date, heure et lieu de comparution signé par l’autorité devant y procéder ont été dûment signifiés à l’intéressé au Canada, et que lui a été accordée l’indemnité légale pour ses frais de déplacement et de comparution, le défaut, par refus ou négligence, de comparaître pour témoigner ou répondre à toute question légitime posée lors de son audition, ou de produire tout document qu’il a été sommé de produire, équivaut à un outrage au tribunal et est punissable à ce titre selon la procédure applicable en l’espèce.
