Similarly, Article 90(1) of the Staff Regulations, which applies to temporary staff pursuant to Article 46 of the CEOS, itself envisages a situation in which, on expiry of the four-month period from the date on which a request is made, the absence of a reply — of its nature without a statement of reasons — is deemed to constitute an implied decision rejecting it, such that the reasons set out by the AECE in that situation can be contested by the temporary staff member only at the contentious stage.
Ebenso erfasst Art. 90 Abs. 1 des Statuts, der auf Bedienstete auf Zeit gemäß Art. 46 der BSB anwendbar ist, den Fall, dass innerhalb der Frist von vier Monaten ab der Einreichung des Antrags keine Antwort – und damit naturgemäß keine Begründung – gegeben wird, was als stillschweigende Ablehnung gilt, gegen die eine Beschwerde zulässig ist, so dass die von der Einstellungsbehörde vorgebrachten Gründe in diesem Fall von dem Bediensteten auf Zeit erst im gerichtlichen Verfahren angefochten werden können.
