66 Aus dem ersten und dem zweiten Satz von Randnummer 42 des angefochtenen Urteils ergibt sich nämlich, dass das Gericht unabhängig davon, ob die Standbeutel für Fruchtgetränke und Fruchtsäfte verwendet werden können, festgestellt hat, dass die angemeldeten Marken nicht unterscheidungskräftig seien, weil diese Verpackungsart in der Gemeinschaft bereits für flüssige Lebensmittel im Allgemeinen verwendet werde und somit nicht derart ungewöhnlich sei, dass der Durchschnittsverbraucher diese Verpackung als solche als Hinweis auf die besondere betriebliche Herkunft einer Ware dieser Kategorie wahrnähme.
