Die Kontrollen sind obligatorisch und können nicht einem einzelnen Unternehmen direkt in Rechnung gestellt werden, da sie auf die Überwachung der gesamten Lebensmittelkette abzielen (sie kommen allen Wirtschaftsteilnehmern zugute und sollen den Schutz der Gesundheit und die Sicherheit der Lebensmittel in Belgien gewährleisten). Bei der über Beiträge erfolgenden Finanzierung eines Teils der Kosten der BSE-Tests und der übrigen direkt mit der Erzeugung/Vermarktung bestimmter Erzeugnisse verbundenen Kontrollen handelt es sich um staatliche Beihilfen, die mit dem Gemeinschaftsrahmen für staatliche Beihilfen im Rahmen von TSE-Tests im Einklang stehen. Der eigentliche Finanzierungsmechanismus umfasst keine besonderen Bestimmungen, die im Widerspruch zu anderen Bestimmungen des EG-Vertrages stünden, und bei den Parametern, anhand deren der Gesamtbetrag der Beiträge auf die Wirtschaftsteilnehmer aus den einzelnen Sektoren aufgeteilt wird, handelt es sich um objektive, gerechte Kriterien ohne Elemente, die zu einer diskriminierenden Behandlung aufgrund des Ursprungs der Erzeugnisse führen könnten.
