Im Dezember 2015 erklärte das deutsche Bundesverfassungsgericht, dass sich der Grundrechtsschutz im Einzelfall auch auf unionsrechtlich determinierte Hoheitsakte erstrecken kann, wenn dies zur Wahrung der durch Artikel79 des deutschen Grundgesetzes verbürgten Verfassungsidentität unabdingbar geboten ist. Nach dem Schuldgrundsatz,der in der Menschenwürdegarantie des Artikels1 des Grundgesetzes wurzelt, setzt jede strafrechtliche Sanktion den Nachweis von Tat und Schuld in einem prozessordnungsgemäßen Verfahren voraus.
