Der wichtigste Vorbehalt gegen die vorgeschlagene Formulierung von Artikel 2 ist die Überschneidung von Arzneimitteln mit so genannten „Borderline-Produkten“, für die einerseits eine spezifische europäische Regelung für die Marktzulassung gilt, wie beispielsweise für Nahrungsergänzungsmittel, kosmetische Erzeugnisse usw., die eine gewisse Heilwirkung haben, aber nicht als Arzneimittel im Sinne dieser Richtlinie gelten.
