The courts in the Member State where the cultural object is found are obliged to order its return
if the Member State from which it came can pr
ove that the object ranks as a national treasure under Article 36 of the Treaty and was removed from its territory unlawfully after 31 December 1992. If those conditions are met, return may be refused only in the event of a time limitation. In certain circumstances, the person in possession of the object is entitled to fair compensation fr

Die Gerichte des Mitgliedstaats, in dem das Kulturgut aufgefunden wird, haben die Rückgabe anzuordnen, wenn der Herkunftsmitgliedstaat des Gegenstandes nachweist, daß es sich gemäß den obengenannten Kriterien um ein nationales Kulturgut handelt und daß dieses nach dem 31.12.1992 unrechtmäßig aus seinem Staatsgebiet verbracht wurde.
