In the light of the evidence set out above, the Tribunal finds that the applicant has failed to prove to the requisite legal standard that the fact that the candidates who were examined last had more time to prepare for the case study and some candidates could have obtained information from other candidates about the content of the version of the subject on which they were going to be examined, was capable of giving the candidates who sat the case study last a genuine advantage over the other candidates.
Vor dem Hintergrund dieser Erwägungen ist festzustellen, dass der Kläger nicht rechtlich hinreichend nachgewiesen hat, dass der Umstand, dass die Bewerber, die als Letzte geprüft wurden, mehr Zeit hatten, um sich auf die Fallstudie vorzubereiten, und dass manche Bewerber von anderen Bewerbern Informationen zum Inhalt der Variante erhalten konnten, mit der sie geprüft werden würden, geeignet war, den Bewerbern, die die Fallstudie als Letzte bearbeitet haben, einen tatsächlichen Vorteil gegenüber den anderen Bewerbern zu verschaffen.
