L’hypothèque enregistrée prend rang avant un intérêt — ou, au Québec, un droit — enregistré postérieurement et portant sur les mêmes terres d’une première nation, pour le montant des avances faites au titre de l’hypothèque — même celles qui sont postérieures à l’enregistrement de l’autre intérêt ou droit — jusqu’à concurrence du montant de l’hypothèque, sauf si le créancier hypothécaire avait connaissance de l’enregistrement postérieur de cet intérêt ou droit avant d’effectuer les avances.
