In its judgment of 27 October 1994 it considered that a loophole in the law in the Netherlands which allowed a married woman to deny her husband's paternity with respect to their child and thus prevent the establishment of legal ties between the child and the biological father also constituted a violation of that right.
De même, dans son arrêt du 27 octobre 1994, la Cour statua que ce même droit était enfreint en raison de l'existence d'une lacune juridique en Hollande, permettant à une femme mariée de nier la paternité de son enfant à son mari, ce vide juridique empêchant alors l'établissement de liens légaux entre l'enfant et le père biologique.
