Dans son arrêt du 11 mai 2000 (C-296/98), la Cour a déclaré non compatible avec le droit communautaire l'exigence prévue dans la législation française, selon laquelle les entreprises d'assurance ou de capitalisation doivent, lorsqu'elles commercialisent pour la première fois en France un modèle de contrat d'assurance, fournir à l'institution française compétente une "fiche de commercialisation".
In its judgment of 11 May 2000 in Case C-296/98, the Court of Justice ruled that French law was incompatible with Community law in providing that insurance or capitalisation undertakings which market for the first time in France a standard form contract must send the competent French authority a marketing information sheet.
