I've checked with a lot of crown attorneys who have told me that in many cases reasonable and probable grounds have been adequately shown and the person who has been tested has blown way over the legal limit, yet because an officer has maybe been in doubt about something totally unrelated to whether the person was impaired or not, the defence has argued that if the officer couldn't remember whether there were three, four, five or six people in the vehicle, how on earth could he have reasonable grounds to request a breathalyzer test, in spite of the initial screening test that showed he did?
