If the national court, first, is unable to identify the place of domicile of the consumer in the territory of the European Union and, second, has no firm evidence to support the conclusion that the consumer is in fact domiciled outside the European Union, the rule according to which, in the event of a dispute, jurisdiction is vested in the courts of the Member State in which the consumer is domiciled must be understood as referring not only to his current domicile but also to his last known domicile.
Si le juge national, d'une part, ne peut identifier le domicile du consommateur sur le territoire de l'Union et, d'autre part, ne dispose pas d’indices probants lui permettant de conclure que celui-ci est effectivement domicilié en dehors de l'Union, la règle selon laquelle, en cas de litige, la juridiction compétente est celle de l'État membre du domicile du consommateur doit être comprise comme visant non seulement le domicile actuel du consommateur mais également son dernier domicile connu.
