I think that a generally well informed citizen would be quite surprised if the courts were forced to review the case and set another sentence, all the more so in that this could create a legal void. If the sentence was quashed, that is to say if a three year sentence was originally handed down and was subsequently quashed on appeal and the case re-opened, the offender more than likely would already be in prison and problems of a practical nature could arise.
Je pense que le citoyen généralement bien informé serait très surpris que l'on oblige le processus, que l'on remette les tribunaux à la disposition pour retrancher à nouveau et fixer une autre sentence, d'autant plus que cela peut créer un vide juridique, parce que la partie ou la sentence est annulée, si la sentence est trois ans et que l'appel vient l'annuler par la suite et qu'on retourne le dossier, l'individu était probablement en prison à ce moment-là et cela peut causer des problèmes d'application pratiques.
