The three justices decided on the basis of the charter that the seven accused were entitled to an oral hearing. However it was the other three, in terms of the Canadian Bill of Rights, who cited section 2(e), which said that no law should “deprive a person of the right to a fair hearing in accordance with the principles of fundamental justice for the determination of the rights and obligations”.
Trois juges ont décidé, en se fondant sur la charte, que les sept accusés avaient droit à une audition, mais trois autres juges ont invoqué l'alinéa 2e) de la Déclaration canadienne des droits, qui stipule qu'aucune loi ne doit «priver une personne du droit à une audition impartiale de sa cause, selon les principes de justice fondamentale, pour la définition de ses droits et obligations».
