If, however, such a settlement agreement also includes a licensing of the technology rights concerned by the underlying dispute, and that agreement leads to a delayed or otherwise limited ability for the licensee to launch the product on any of the markets concerned, the agreement may be caught by Article 101(1) and would then need to be assessed in particular in the light of Articles 4(1)(c) and 4(1)(d) of the TTBER (see section 3.4.2 above).
Si, toutefois, un tel accord de règlement porte également sur la concession des droits sur technologie concernés par le litige sous-jacent et entraîne un report ou toute autre limitation de la capacité du preneur à lancer le produit sur l’un quelconque des marchés en question, ledit accord peut tomber sous le coup de l’article 101, paragraphe 1, et devrait alors être apprécié notamment au regard de l’article 4, paragraphe 1, points c) et d), du règlement d’exemption par catégorie (voir la section 3.4.2 ci-dessus).
