the contracting authority establishes that a tender is abnormally low on grounds that the tenderer has obtained a State aid, the tender can only be rejected after consultation with the tenderer where the latter is unable to prove, within a sufficient timeframe fixed by the contracting authority, that the aid in question was notified to the Commission under Article 88(3) of the Treaty and authorised.
Le pouvoir adjudicateur, qui constate qu'une offre est anormalement basse du fait de l'obtention d'une aide d'Etat par le soumissionnaire, ne peut rejeter cette offre que s'il consulte le soumissionnaire et si celui-ci n'est pas en mesure de démontrer, dans un délai suffisant fixé par le pouvoir adjudicateur, que l'aide en question a été notifiée à la Commission en vertu de l'article 88, paragraphe 3, du traité et a été autorisée par celle-ci.
