It is important to note here that in Ontario, which has a remedial procedure similar to the one outlined in clause 46, the Court of Appeal upheld the decision of the Ontario Labour Relations Board to certify a union when it found, after 35 days of hearings, that a certain company had committed unfair labour practices during a union organizing drive.
