33. If spouses or common-law partners e
nter into a written agreement, after they cease to cohabit, that sets out the amount to which each is entitled and how to settle the amount payable by one of the methods referred to in subparagraph 30(1)(b)(i),
(ii) or (iv) or any combination of those methods, a court may, on application by one of them, make an order to enforce that agreement if the court is satisfied that the consent of both parties to the agreement was free and informed, and that the agreement is not unconscionable, having rega

33. Dans le cas où, après la cessation de la cohabitation, les époux ou conjoints de fait conviennent par écrit de la somme à laquelle chacun a droit et du règlement de la somme due par l’un des moyens visés aux sous-alinéas 30(1)b)(i), (ii) ou (iv) ou toute combinaison de ceux-ci, le tribunal peut, sur demande de l’un d’eux, ordonner l’exécution de cet accord s’il est convaincu qu’ils y ont consenti de façon libre et éclairée et que l’accord n’est pas injuste compte tenu notamment des facteurs énoncés à l’article 29.
