I would also argue that in determining how far the federal government’s appointing powers can be circumscribed by legislation, attention should be paid to the provisions of the Canadian Charter of Rights and Freedoms, notably the non-discrimination provisions in section 15 of the charter, as well as the long-established doctrines of judicial independence and tenure, as enshrined in section 99 of the Constitution Act and the unwritten principles of the Canadian Constitution.
J'estime aussi qu'en cherchant à déterminer dans quelle mesure les pouvoirs de nomination du gouvernement fédéral peuvent être encadrés par une loi, il faut tenir compte des dispositions de la Charte canadienne des droits et libertés, notamment de l'article 15 qui interdit la discrimination, ainsi que de très anciens principes comme ceux de l'indépendance de la magistrature et de l'inamovibilité des juges, tels que formulés à l'article 99 de la Loi constitutionnelle et qui font partie des principes non écrits de la Constitution canadienne.
