45 Nach alledem ist festzustellen, dass die Beschwerdekammer mit ihrer Feststellung, die Anmeldemarke habe keine Unterscheidungskraft, den Wortlaut von Art. 7 Abs. 1 Buchst. b der Verordnung Nr. 40/94 verkannt hat, aus dem sich ergibt, dass ein Minimum an Unterscheidungskraft genügt, um das darin geregelte Eintragungshindernis entfallen zu lassen (Urteile des Gerichts vom 27. Februar 2002, Eurocool Logistik/HABM [EUROCOOL], T‑34/00, Slg. 2002, II‑683, Randnr. 39, Kühlergrill, Randnrn. 33 und 49, und Form einer Flasche, Randnr. 42).
In the light of all (of) the foregoing considerations, it must be concluded that, by taking the view that the trade mark applied for was devoid of any distinctive character, the Board of Appeal misconstrued the wording of Article 7(1)(b) of Regulation No 40/94 from which it follows that a minimum degree of distinctive character is sufficient to render inapplicable the ground for refusal set out in that article (Case T-34/00 Eurocool Logistik v OHIM (EUROCOOL) [2002] ECR II‑683, paragraph 39.Grille, paragraphs 33 and 49; and Shape of a bottle, paragraph 42).
