Die Stellungnahme des Ausschusses ist nämlich keineswegs bindend, und Artikel 14 kann, da es um die Volksgesundheit geht, nicht dahin ausgelegt werden, daß er die Mitgliedstaaten verpflichtet, die Stellungnahme des Ausschusses auch dann noch abzuwarten, wenn die 60-Tage-Frist für deren Abgabe abgelaufen ist, bevor sie beschließen, eine Arzneispezialität zurückzuziehen, in der sie eine mögliche Gefahr für die Volksgesundheit sehen, deren Schutz das wesentliche Ziel der Richtlinie 65/65 darstellt.
The opinion of the CPMP is in no way binding. Moreover, since the issue is one of public health, Article 14 cannot be construed as requiring Member States to await the CPMP's opinion, even after the period of 60 days allowed for its production has expired, before deciding to withdraw a medicinal product that may prove to be harmful to public health, the protection of which constitutes the primary objective of Directive 65/65.
