Dieses Ergebnis wird auch durch das New Yorker Übereinkommen bestätigt, wonach es das Gericht, bei dem ein Rechtsstreit anhängig gemacht wird, hinsichtlich dessen die Parteien ein Schiedsverfahren vereinbart haben, ist, das die Parteien auf Antrag einer von ihnen auf das schiedsrichterliche Verfahren verweist, sofern es nicht feststellt, dass die Vereinbarung hinfällig, unwirksam oder nicht erfüllbar ist.
This finding is also supported by the New York Convention, according to which it is the court, when seised of an action in a matter in respect of which the parties have made provision for arbitration, that will, at the request of one of the parties, refer the parties to arbitration, unless it finds that the arbitration clause is null and void, inoperative or incapable of being performed.
