24. besteht darauf, dass das „Loser Pays“-Prinzip, nach dem die unterlegene Partei die Kosten des Rechtsstreits trägt, eingehalten werden muss, um zu vermeiden, dass aussichtslose Klagen in einem EU-weiten System von Sammelklagen überhand nehmen, wobei – im Einklang mit dem einzelstaatlichen Recht und unter Beachtung des Subsidiaritätsprinzips – die Möglichkeit besteht, dass das Gericht nach seinem Ermessen die Gerichtskosten, die von der unterlegenen Partei zu tragen sind, herabsetzt oder der Staat Prozesskostenhilfe gewährt;

Insists on the need to respect the ‘loser pays’ principle, according to which the losing party pays for the costs of the proceedings in order to avoid the proliferation of unmeritorious claims in an EU-wide collective redress mechanism, allowing the judge to reduce at his discretion the court fees paid by the losing party or the state to provide legal aid, in accordance with national law respecting the principle of subsidiarity;
