Dabei verwies das Panel in Nummer 7.213 seines Berichts ausdrücklich auf „ein vergleichbares Darlehen zu marktüblichen Bedingungen“ (Artikel 14 Buchstabe b des WTO-Subventionsübereinkommens) und auf „ein vergleichbares Darlehen ohne Bürgschaftsleistung der Regierung“ (Artikel 14 Buchstabe c des WTO-Subventionsübereinkommens) und in diesem Zusammenhang auch auf die so genannten „Ramsch“- oder „Schrottanleihe“ („junk bond“) und die „Geierfonds“ („vulture funds“) (30).
The Panel particularly referred, at para. 7.213 of its report, to ‘a comparable commercial loan which the firm could actually obtain on the market’ (Article 14(b) SCM Agreement) and ‘a comparable commercial loan absent the government guarantee’ (Article 14(a) SCM Agreement). The Panel also referred, by way of example, to so-called ‘junk bonds’ or ‘vulture funds’ (30).
