The same principle should apply to the confiscation of goods transferred to a partner or cohabitee or to a legal person – i.e. it should have to be proven that the property of the partner or cohabitee belongs to the person convicted and that the partner or cohabitee or the representatives of the legal person have only fictitious title or access to it.

2. Last but not least, although I feel it is essential for it to be possible to confiscate crime-related proceeds, where these have been fictitiously transferred to the spouse or cohabitee or to another legal person, the prosecution must prove that the property of the spouse, cohabitee or other legal person does genuinely belong to the convicted person and that the other persons therefore only have fictitious title or access to it.

Abschließend halte ich es darüber hinaus für erforderlich, dass Vermögensgegenstände des Ehe- oder Lebenspartners oder einer anderen juristischen Person eingezogen werden können, doch muss in diesem Fall vonseiten der Anklage nachgewiesen werden, dass diese Vermögensgegenstände des Ehe- oder Lebenspartners oder einer anderen juristischen Person effektiv dem Verurteilten gehören und diese anderen Personen die rechtliche oder tatsächliche Verfügungsgewalt nur zum Schein innehaben.
