Die Richtlinie steht jedoch einer nationalen Maßnahme, mit der für die Ausübung des Berufs des Vertragszahnarztes eine Höchstaltersgrenze, im vorliegenden Fall 68 Jahre, festgelegt wird, entgegen, wenn diese Maßnahme nur das Ziel hat, die Gesundheit der Patienten vor dem Nachlassen der Leistungsfähigkeit von Vertragszahnärzten, die dieses Alter überschritten haben, zu schützen, da diese Altersgrenze nicht für Zahnärzte außerhalb des Vertragszahnarztsystems gilt.
