Nach Auffassung der Kommission beeinträchtigen die Regelungen der drei Mitgliedstaaten, die Mindestpreise in Höhe eines bestimmten Prozentsatzes der Durchschnittspreise der betreffenden Tabakwaren (95% in Frankreich, 92,75% für Zigaretten und 90% für Feinschnitt in Österreich sowie 97% in Irland) vorschreiben, die Freiheit der Hersteller und der Einführer, die Kleinverkaufshöchstpreise ihrer Erzeugnisse zu bestimmen, und damit den freien Wettbewerb.
