In addition, considering that that method of calculation does not take into account all the relevant circumstances and pointing out that it is not bound by that method, the General Court holds that the final amount of the fine imposed on each company must, particularly in light of the duration and gravity of the infringement, be set at €320 million.
Das Gericht gelangt daher angesichts des Umstands, dass diese Berechnungsmethode nicht alle erheblichen Umstände berücksichtigt, und unter Hinweis darauf, dass es durch diese Methode nicht gebunden ist, zu dem Ergebnis, dass der Endbetrag der gegen jede Gesellschaft zu verhängenden Geldbuße unter Berücksichtigung insbesondere der Dauer und der Schwere der Zuwiderhandlung auf 320 Mio. Euro festzusetzen ist.
