If the EFTA Surveillance Authority has not ruled on an aid measure, national courts can always be guided, in interpreting national law which implemented EEA law, by the case-law of the EFTA Court, the Court of Justice and the Court of First Instance of the European Communities, as well as by decisions issued by the EFTA Surveillance Authority and the Commission.
(6) Solange die EFTA-Überwachungsbehörde nicht über eine Beihilfemaßnahme entschieden hat, können sich die nationalen Gerichte bei der Auslegung des innerstaatlichen Rechts, mit dem das EWR-Recht umgesetzt wurde, auf die Rechtsprechung des EFTA-Gerichtshofs, des Europäischen Gerichtshofs und des Gerichts erster Instanz sowie auf Beschlüsse und Entscheidungen der EFTA-Überwachungsbehörde und der Kommission stützen.
