1. Where a defendant habitually resident in a State other than the Member State where the action was brought does not enter an appearance, the court having jurisdiction shall stay the proceedings so long as it is not shown that the defendant has been able to receive the document instituting the proceedings or an equivalent document in time to arrange for his defence, or that all necessary steps have been taken to that end.
(1) Lässt sich der Beklagte, der seinen gewöhnlichen Aufenthalt im Hoheitsgebiet eines anderen Staates als des Mitgliedstaats hat, in dem das Verfahren eingeleitet wurde, auf das Verfahren nicht ein, so setzt das zuständige Gericht das Verfahren so lange aus, bis festgestellt ist, dass es dem Beklagten möglich war, das verfahrenseinleitende Schriftstück oder ein gleichwertiges Schriftstück so rechtzeitig zu empfangen, dass er sich verteidigen konnte oder dass alle hierzu erforderlichen Maßnahmen getroffen wurden.
