Der Disziplinarrat befindet nämlich darüber, ob der betreffende Beamte insbesondere gegen die sich aus dem Statut ergebenden Pflichten oder allgemein gegen das Unionsrecht verstoßen hat, und seine Stellungnahme soll dazu führen, dass das Organ, dem der Beamte angehört, eine Entscheidung erlässt, die für den Beamten günstig oder ungünstig sein kann; ganz anders verhält es sich bei der Entscheidung über die Übermittlung von Informationen, da sich das OLAF darauf beschränkt, den nationalen Justizbehörden Informationen zu übermitteln, deren strafrechtliche Bewertung ausschließlich Sache dieser Behörden ist.
