The appellant considers that the CST, first, infringed the first paragraph of Article
43 of the Rules of Procedure of the CST by failing to take account of the fact that the submissions at issue were bas
ed on documents and information which the FRA produced only in the course of the proceedings before the CST and, second, failed to recognise that the submissions at issue must be held to be admissible on the ground that they were closely connected with other ple
as submitted in the written ...[+++] procedure. Third, and in any event, the CST erroneously concluded, without any motivation, that the plea was not among the pleas which the Tribunal may raise of its own motion.
Die Rechtsmittelführerin ist der Ansicht, dass das GöD, erstens, gegen Art. 43 Abs. 1 der Verfahrensordnung des GöD verstoßen habe, indem es nicht berücksichtigt habe, dass das streitige Vorbringen auf Dokumente und Informationen gestützt gewesen sei, die die FRA erst während des Verfahrens vor dem GöD vorgelegt habe und, zweitens, nicht festgestellt habe, dass das streitige Vorbringen für zulässig zu erklären sei, da es eng mit anderen im schriftlichen Verfahren vorgebrachten Rügen verbunden gewesen sei.
