Insists that the aforementioned limitation on the scope of the EAEC Treaty should not be invoked to avoid the application of health and safety legislation in situations where the alleged military purpose concerns a third State, where the use of nuclear energy is in breach of an international agreement and where the only feasibly present connection with a defence interest of a Member State is that the release of nuclear material occurred on its territory;
5. betont, dass die erwähnte Beschränkung des Anwendungsbereichs des Euratom-Vertrags nicht angeführt werden sollte, um die Anwendung von Vorschriften zum Gesundheitsschutz in Situationen zu vermeiden, bei denen ein mutmaßlicher militärischer Zweck einen Drittstaat betrifft, bei denen die Nutzung von Atomenergie unter Verletzung eines internationalen Abkommens erfolgt und wo das einzige denkbar vorhandene Verbindungselement zu einem Interesse der Landesverteidigung eines Mitgliedstaates darin liegt, dass die Freisetzung von nuklearem Material auf seinem Hoheitsgebiet erfolgte;
