(46a) When applying this Regulation to solve the issues raised by any conflict of law, it is important that this Regulation does not seek to determine the law applicable to the treatment in insolvency proceedings of financial instruments recorded on an account maintained by a CSD or the effect with respect to such financial instruments of death, dissolution, inheritance or succession, divorce, mental health, incapacity or criminal proceedings.
(46a) Bei der Anwendung dieser Verordnung zur Lösung von Fragen, die bei einer etwaigen Normenkollision auftreten, ist es wichtig, dass durch diese Verordnung nicht das Recht bestimmt werden soll, das auf die Behandlung von Insolvenzverfahren von Finanzinstrumenten, die auf einem von einem Zentralverwahrer geführten Konto verbucht sind, oder die Wirkung von Tod, Auflösung, Nachlass oder Erbschaft, Scheidung, geistige Gesundheit, Invalidität oder Strafverfahren hinsichtlich solcher Finanzinstrumente anwendbar ist.
