In that context, the Advocate General takes the view, first, that the fact that the holders of exclusive rights to operate gaming in the Netherlands are authorised to make their offers attractive by creating new games and advertising is not, as such, inconsistent with the aims of the Netherlands legislation taken as a whole because that standpoint contributes perfectly to the prevention of fraud.
Dazu hat der Generalanwalt erstens festgestellt, dass die den Inhabern ausschließlicher Rechte für den Betrieb von Glücksspielen in den Niederlanden eingeräumte Befugnis, ihr Angebot durch die Einführung neuer Spiele und durch Werbung attraktiver zu machen, als solche nicht inkohärent mit den von der niederländischen Regelung verfolgten Zielen in ihrer Gesamtheit ist, weil dieses Verhalten durchaus zur Bekämpfung von Betrügereien beiträgt.
