Second, it observes that, according to the Sixth Directive, the application of the deductible proportion in respect of taxable persons who receive subsidies which do not form part of the price of the good or service provided and which do not form part of the taxable amount for VAT purposes is only provided for in the case of mixed taxable persons, that is, taxable persons who carry out, at the same time, transactions in respect of which VAT is deductible and transactions in respect of which VAT is not deductible.
Sodann führt er aus, dass nach der Sechsten Richtlinie der Pro-rata-Satz des Vorsteuerabzugs nur auf gemischt steuerpflichtige Personen anzuwenden ist, die Subventionen erhalten, die nicht in den Preis des gelieferten Gegenstands oder der erbrachten Dienstleistung einfließen und nicht Teil der Bemessungsgrundlage für die Mehrwertsteuer sind. Gemischt steuerpflichtige Personen tätigen sowohl Umsätze, die das Recht auf Vorsteuerabzug eröffnen, als auch Umsätze, die dieses Recht nicht eröffnen.
