It should be added that, in so far as it is admissible, the present dispute is not a dispute of a financial character within the meaning of Article 91(1) of the Staff Regulations, and the Tribunal does not therefore have unlimited jurisdiction in this case, which prevents it from examining whether it is necessary for it, of its own motion, to order the defendant to pay compensation for the damage caused by the defendant’s wrongful act (see, to that effect, judgment of 20 May 2010 in Case C-583/08 P Gogos v Commission, paragraph 44).
Hinzuzufügen ist, dass der vorliegende Rechtsstreit, soweit er zulässig ist, keine Streitsache vermögensrechtlicher Art im Sinne von Art. 91 Abs. 1 des Statuts ist und das Gericht im vorliegenden Fall demnach keine Befugnis zu unbeschränkter Ermessensnachprüfung hat, weshalb es nicht prüfen kann, ob die beklagte Partei von Amts wegen zur Zahlung einer Entschädigung für den durch ihren Amtsfehler entstandenen Schaden zu verurteilen ist (vgl. in diesem Sinne Urteil des Gerichtshofs vom 20. Mai 2010, Gogos/Kommission, C-583/08 P, Randnr. 44).
