The need for special procedural guarantees of a nature that could prevent the application of accelerated or border procedures should also mean that the applicant is provided with additional guarantees in cases where his or her appeal does not have automatic suspensive effect, with a view to making the remedy effective in his or her particular circumstances.
Die Notwendigkeit besonderer Verfahrensgarantien, die der Anwendung des beschleunigten Verfahrens oder des Grenzverfahrens entgegenstehen könnten, sollte ferner bedeuten, dass der Antragsteller zusätzliche Garantien erhält, wenn sein Rechtsbehelf nicht automatisch aufschiebende Wirkung hat, damit der Rechtsbehelf unter den besonderen Umständen seines Falles effektiv ist.
