Since the objective of the proposed action, namely the achievement of a uniform, constant and high level of protection for all European citizens in road tunnels, cannot be sufficiently achieved by the Member States and can therefore, by reason of the level of harmonisation required, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.
Da das Ziel der vorgeschlagenen Maßnahme, nämlich die Verwirklichung eines einheitlichen, konstanten und hohen Schutzniveaus in Straßentunneln für alle europäischen Bürger auf Ebene der Mitgliedstaaten nicht ausreichend erreicht werden kann und daher in Anbetracht des erforderlichen Harmonisierungsgrads besser auf Gemeinschaftsebene zu erreichen ist, kann die Gemeinschaft im Einklang mit dem in Artikel 5 des Vertrags niedergelegten Subsidiaritätsprinzip tätig werden.
