The High Level Group noted that the Societas Europaea (SE), adopted in October 2001, may not meet all expectations of the business community, in particular SMEs, and referred to the development, from a private initiative, of a "European Private Company" (EPC) which, as a new legal form at EU level, would primarily serve the needs of SMEs which are active in more than one Member State.
