It follows that there is no likelihood of confusion between the ‘F1’ word marks and the figurative mark applied for, since consumers will not connect the ‘F1’ element in the mark applied for with Formula One Licensing because the only sign that they have learned to associate with the latter is the logotype and they will regard the designation ‘F1’ in ordinary typeset as descriptive.
Folglich besteht keine Verwechslungsgefahr zwischen den Wortmarken „F1“ und der angemeldeten Bildmarke, denn die Verbraucher werden den Bestandteil „F1“ in der Anmeldemarke nicht Formula One Licensing zuordnen, weil das einzige Zeichen, das sie mit dieser in Verbindung zu bringen gelernt haben, das Logo ist, und sie werden die Bezeichnung „F1“ in Standardschrift als beschreibend auffassen.
