The competent court should assess the circumstances of the individual case and inter alia should take into account whether the alleged infringer is a small and medium-sized enterprise operating only at local level, the language of the proceedings before the European Patent Office and, during the transitional period, the translation submitted together with the request for unitary effect.
Das zuständige Gericht sollte die Umstände im Einzelfall prüfen und unter anderem berücksichtigen, ob es sich bei dem mutmaßlichen Patentrechtsverletzer um ein kleines oder mittleres Unternehmen handelt, das nur auf lokaler Ebene tätig ist, sowie die Verfahrenssprache vor dem Europäischen Patentamt und, während eines Übergangszeitraums, die zusammen mit dem Antrag auf einheitliche Wirkung vorgelegte Übersetzung berücksichtigen.
