The Court of Justice of the EU has already ruled that such nationality requirements are contrary to the freedom of establishment under the Treaty on the Functioning of the EU (Article 49) because the activities of notaries are not covered by an exception under Article 51 of the TFEU regarding activities linked to public authority (see its judgments of 24.5.2011 concerning Belgium, France, Luxembourg, Austria, Germany and Greece).
Der Gerichtshof der Europäischen Union hat bereits entschieden, dass ein solches Erfordernis gegen die Niederlassungsfreiheit gemäß Artikel 49 des Vertrags über die Arbeitsweise der Europäischen Union (AEUV) verstößt, da die Tätigkeit von Notaren nicht von der Ausnahmeregelung des Artikels 51 AEUV über Tätigkeiten zur Ausübung öffentlicher Gewalt abgedeckt ist (siehe die Urteile vom 24.5.2011 betreffend Belgien, Frankreich, Luxemburg, Österreich, Deutschland und Griechenland).
