It is necessary to point out that the 1975 additional Protocol has no bearing on this Convention because it is limited to amending Article XXIV of the Concordat to enable civil courts to issue a decree of divorce in the case of canonical marriages, which was forbidden to both civil and ecclesiastical courts by the original version of the Concordat as canonical law does not recognise the dissolution of marriage by divorce.
Es ist darauf hinzuweisen, daß das Zusatzprotokoll von 1975 für das hier behandelte Übereinkommen insofern nicht relevant ist, als es sich auf eine Änderung des Artikels XXIV des Konkordats in dem Sinne beschränkt, daß den Zivilgerichten gestattet wird, die Scheidung von nach den Regeln des Konkordats geschlossenen Ehen auszusprechen, was nach der ursprünglichen Fassung des Konkordats weder Zivilgerichten noch Kirchengerichten möglich war, da das kanonische Recht die Auflösung der Ehe durch Scheidung nicht kennt.
