Pursuant to Article 9(5) of the basic Regulation, a country-wide duty, if any, is established for countries falling under Article 2(7)(a) of the basic Regulation, except in those cases where companies are able to demonstrate that their export prices and quantities as well as the conditions and the terms of sales are freely determined, that exchange rates are carried out at market rates, and that any State interference is not such as to permit circumvention of measures if exporters are given different rates of duty.
Gemäß Artikel 9 Absatz 5 der Grundverordnung wird für die Länder, die unter Artikel 2 Absatz 7 Buchstabe a) der Grundordnung fallen, gegebenenfalls ein landesweiter Zoll festgesetzt, außer wenn Unternehmen nachweisen können, dass ihre Ausfuhrpreise und -mengen sowie die Bedingungen der Verkäufe frei bestimmt sind, Währungsumrechnungen zu Marktkursen erfolgen und der Staat nicht in einem solchen Maße Einfluss nimmt, dass die Maßnahmen im Falle der Festsetzung unterschiedlicher Zollsätze für einzelne Ausführer umgangen werden können.
