t for the terrorist risk in the liability scheme of the Athens Convention is at present under discussion at IMO (legal committee-LEG). It is linked to a so called impossibility of insuring those risks (at least from the PI point of view) with regard to Article 3.1 (b) of the Convention which states that the carrier is not liable only unless he proves that the incident "was wholly caused by an act or omission done with the intent to cause the incident by a third party". The compromise would consist of having a specific coverage of terrorist risks by organising the currently
available ...[+++] war risk insurance in such a way as to establish an entity similar to the PI Clubs that could act as the provider of insurance cover.
(I) hinsichtlich Artikel 3 Absatz 1 Buchstabe b des Übereinkommens, in dem geregelt ist, dass der Beförderer nicht haftet, es sei denn, er weist nach, dass das Ereignis „ausschließlich durch eine Handlung oder Unterlassung verursacht wurde, die von einem Dritten in der Absicht, das Ereignis zu verursachen, begangen wurde“. Der Kompromiss bestünde darin, eine spezifische Abdeckung von Terrorrisiken dadurch zu erreichen, dass die derzeit verfügbaren Kriegsrisikoversicherungen so gestaltet werden, dass eine den PI-Clubs ähnliche Einrichtung geschaffen wird, die als Versicherungsträger auftreten könnte.
