The US required that not later than October 26, 2004, each country that is designated to participate in the VWP "shall certify, as a condition for designation or continuation of that designation, that it has a program to issue to its nationals machine-readable passports that are tamper-resistant and incorporate biometric and document authentication identifiers that comply with applicable biometric and document identifying standards established by the International Civil Aviation Organisation".
Die Vereinigten Staaten forderten, dass jeder Staat, der für die Teilnahme am VWP in Frage kommt, ab dem 26. Oktober 2004 „als Bedingung für die Befreiung von der Visumpflicht oder deren Fortführung [nachweist], dass er über ein Programm zur Erteilung von Pässen an seine Staatsangehörigen verfügt, die maschinenlesbar und fälschungssicher sind sowie biometrische Identifikatoren enthalten, die den von der Internationalen Zivilluftfahrtorganisation in Bezug auf solche Identifikatoren aufgestellten Normen entsprechen“.
