In the present case, as the job description contained in the vacancy notice corresponded to administrative and advisory functions, functions which, according to Article 5(2) of the Staff Regulations, are performed by staff in function group AD from grade AD 5 upwards, it was right that the vacancy notice provided that officials applying for the post in question should be in one of the grades AD 5 to AD 14 and that the successful candidate would be appointed in his existing grade.
Im vorliegenden Fall hat die Stellenausschreibung, da die in diese aufgenommene Aufgabenbeschreibung konzeptionelle Aufgaben und Studien umfasst, also Aufgaben, die gemäß Art. 5 Abs. 2 des Statuts von Bediensteten der Funktionsgruppe AD ab der Besoldungsgruppe AD 5 ausgeübt werden, zu Recht vorgesehen, dass sich Beamte ab der Besoldungsgruppe AD 5 bis zur Besoldungsgruppe AD 14 auf die fragliche Planstelle bewerben können und dass der ausgewählte Bewerber in seine Besoldungsgruppe eingestuft wird.
